This Privacy Notice for Waivr LLC ("we," "us," or "our") describes how and why we might access, collect, store, use, and share your personal information when you use our services, including when you visit our website at lienwaivr.com or use our lien waiver management platform.

If you have questions or concerns, reading this notice will help you understand your privacy rights and choices. If you disagree with our policies and practices, please do not use our services. If you still have questions, contact us at anthony@lienwaivr.com.

1. What Information Do We Collect

Personal information you provide to us. We collect personal information that you voluntarily provide when you register for an account, use our services, or contact us. This includes:

Names, email addresses, phone numbers, company names, mailing addresses, job titles, usernames, passwords, billing information, and payment data processed through Stripe.

Information automatically collected. When you visit our platform, we automatically collect certain technical information including your IP address, browser type, operating system, referring URLs, device identifiers, and usage data such as pages viewed, features used, and time spent on the platform.

Information from subcontractors. When your subcontractors use our tokenized signing links, we collect their name, email address, IP address, and electronic signature data as part of the waiver execution process.

2. How Do We Process Your Information

We process your personal information for the following purposes:

To provide our services. We use your information to create and manage your account, generate lien waiver documents, send documents for electronic signature, and maintain your compliance dashboard.

To process payments. We use your billing information in conjunction with Stripe to process subscription payments securely.

To communicate with you. We may send you service-related emails including waiver notifications, reminder emails on your behalf to subcontractors, account updates, and responses to your inquiries.

To improve our platform. We analyze usage patterns to improve features, fix bugs, and enhance the user experience.

To comply with legal obligations. We may process your information where required by applicable law.

3. When and With Whom Do We Share Your Personal Information

We do not sell your personal information. We may share your information in the following limited circumstances:

Service providers. We share data with third-party vendors who help us operate our platform, including Stripe (payment processing), Resend (email delivery), and Neon (database hosting). These providers are contractually obligated to protect your data.

Subcontractors you designate. When you send a waiver for signature, we share the relevant document and contact information with the subcontractor you identify.

Legal requirements. We may disclose your information if required by law, court order, or governmental authority, or to protect our legal rights.

Business transfers. In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

4. Do We Use Cookies and Other Tracking Technologies

We use cookies and similar tracking technologies to maintain your session when you are logged in and to understand how our platform is used. We use Google Analytics to collect anonymized usage data to help us improve our services.

You can control cookies through your browser settings. Disabling cookies may affect your ability to use certain features of our platform, including staying logged in.

We do not use cookies for advertising or cross-site tracking purposes.

5. How Do We Handle Your Social Logins

Waivr does not currently offer social login options such as Google or Facebook sign-in. All accounts are created with an email address and password managed directly by Waivr. If we add social login functionality in the future, this policy will be updated accordingly.

6. How Long Do We Keep Your Information

We retain your personal information for as long as your account is active or as needed to provide you with our services. If you cancel your subscription, we will retain your account data for a reasonable period to allow you to reactivate your account and to comply with our legal obligations.

Signed waiver documents and associated signature records are retained for the duration of your account and for a period following account closure, as lien waiver records may have legal significance for years after project completion.

You may request deletion of your account and associated data at any time by contacting us at anthony@lienwaivr.com.

7. How Do We Keep Your Information Safe

We implement commercially reasonable technical and organizational security measures to protect your personal information, including:

256-bit SSL/TLS encryption for all data in transit. Encrypted storage of passwords using bcrypt hashing. Secure, isolated database infrastructure through Neon. Payment data handled exclusively by Stripe and never stored on our servers.

However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security. We recommend that you use a strong, unique password for your Waivr account and notify us immediately if you suspect unauthorized access.

8. Do We Collect Information From Minors

Our services are intended for business use by adults operating in the construction industry. We do not knowingly collect personal information from individuals under the age of 18. If you believe we have inadvertently collected information from a minor, please contact us immediately at anthony@lienwaivr.com and we will take steps to delete such information.

9. What Are Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information, including:

Access. The right to request a copy of the personal information we hold about you.

Correction. The right to request correction of inaccurate or incomplete information.

Deletion. The right to request deletion of your personal information, subject to certain legal exceptions.

Portability. The right to receive your data in a structured, machine-readable format.

Objection. The right to object to processing of your personal information in certain circumstances.

10. Controls for Do-Not-Track Features

Some browsers include a Do-Not-Track (DNT) feature that signals to websites that you do not want your online activity tracked. At this time, there is no uniform standard for recognizing or honoring DNT signals. We do not currently respond to DNT browser signals. If a standard is adopted in the future, we will update this policy accordingly.

11. Do United States Residents Have Specific Privacy Rights

Depending on the state in which you reside, you may have additional rights under applicable state privacy laws. Michigan residents and residents of other states with comprehensive privacy laws may have rights including the right to know what personal data is collected, the right to delete personal data, and the right to opt out of the sale of personal data.

We will verify your identity before processing any request and will respond within the timeframe required by applicable law.

12. Do We Make Updates to This Notice

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through a notice on our platform.

We encourage you to review this policy periodically to stay informed about how we protect your information.

14. How Can You Review, Update, or Delete the Data We Collect From You

You can review and update your account information at any time by logging into your Waivr dashboard and visiting your account settings.

To request deletion of your account and all associated personal data, contact us at anthony@lienwaivr.com with the subject line "Data Deletion Request." We will process your request within 30 days, subject to any legal retention obligations.

Please note that deletion of your account will permanently remove access to all waiver documents stored in the platform. We strongly recommend downloading copies of all signed documents before requesting account deletion.
