Which states require statutory lien waiver forms?

Twelve states currently mandate the use of specific statutory lien waiver forms. In these states, using a non-compliant form can render the waiver unenforceable — leaving property owners exposed to mechanics liens and subcontractors at risk of losing their payment rights.

Each state prescribes four types of waivers: conditional and unconditional versions for both progress (partial) payments and final payments. Conditional waivers only take effect once payment is actually received, while unconditional waivers are effective immediately upon signing.

Even in states without statutory requirements, using a well-structured lien waiver is considered best practice in construction. It protects all parties and creates a clear paper trail for every payment.
